Booking Conditions July 2009

TO MAKE A BOOKING

Telephone Ski Chamois and give all the details of your proposed holiday. You will then be given the Cost if it is not already displayed on the page, and an option taken out for you.
Complete your booking form which you must complete and return to Ski Chamois within three days together with your deposit of £50 per person or the full cost of the holiday if the booking is made within 8 weeks of departure.
A contract exists when Ski Chamois receives completed booking form and sends you a confirmation Invoice. The person signing the booking form warrants that he/she has the authority for other persons included in the holiday to make the booking on their behalf.
The balance must be paid at least 8 weeks prior to departure. If the invoice is not paid by the due date Ski Chamois shall have the option of treating the booking as having been cancelled in which case the deposit is forfeited and cancelation charges as set out below will be applied.

If you wish to change any of the details of your booking form after we have sent your confirmation we will do our best to help. However, we have no obligation to make changes other than allowing you or any member of your party who is prevented from travelling to transfer their booking to someone else, provided you give us reasonable notice. Notification must be in writing to our office if we can make the change there will be a charge as follows. For a name change more than 56 days before departure you will be charged an administration fee of £15 on each change. For changes between 29·56 days £15 for a name change. Cancellation charges as per scale below for any other change. Changes at 28 days or less £25 per name change and cancellation charges as our scale below for any other change.


CANCELLATION BY YOU

Any cancellation made by the client must be made in writing and made in person signing the booking form. In the event of a client cancelling his/hers booking the following charges will be made:
More than 56 days before departure your Deposit is forfeited. 55-29 days before departure 50% of the total cost is forfeited, 28-14 days before departure 75% is forfeited, less than14 before departure or after departure 100% is forfeited.
Insurance cover for cancellation charges can be provided and you should therefore, in your own interest take out our specially arranged insurance through TTA which Provides cancellation coverage for specified reasons.


CANCELLATION BY SKI CHAMOIS

It is unlikely that we will make changes to your once holiday once confirmed but Ski Chamois does reserve the right to make changes should they become necessary. Where a major change is necessary the person signing the booking form will be informed. A major change is where Ski Chamois has to change the day of departure or resort accommodation. Should a major change be necessary the clients will be offered another holiday of at least the same standard or a full refund. However, should we have to alter your holiday within eight weeks of departure the following scale of compensation will become payable to you: 46-15 days £15 per person, between 14-1 days departure £20 per person.
Ski Chamois reserve the right to cancel your holiday and all holidays operate subject to minimum number of participants. However, in no case will we cancel your holiday less than 8 weeks before except for reasons of war, Political unrest, strikes, or force majeure, or failure on your part to pay the balance.  The only liability will be a refund of all monies paid by the client less the costs of any services provided. Compensation payments will not be paid where your holiday is cancelled or changed for reasons included paragraph.


OUR LIABILITY TO YOU

Ski Chamois has taken all reasonable care to ensure that proper arrangements have been made for all holidays we organise. The suppliers of all services provided as part of your holiday are safe and reputable and that they comply with both local and national laws of their countries. We accept full responsibility for the quality of your holiday. If any part is not provided as promised, we will pay you the appropriate compensation if this has affected the enjoyment of your holiday. We accept responsibility for there acts of and/or omissions of our employees, agents and suppliers except where they lead to death, injury or illness. Our liability in all cases shall be limited to a maximum of 2 the original holiday cost per person.
We accept responsibility for death, caused by the negligent acts and/or omissions of our employees or agents together with our suppliers and subcontractors, servants and/or agents of the same whilst acting, within the scope of, or in the course of their employment in the provision of your holiday. We will accordingly pay to our clients such damages as might have been awarded in such circumstances under English law.
In respect of carriage by coach, sea and rail and the provision of accommodation our liability in all cases will be limited in the manner provided by the relevant international convention.
Further should any client have a claim for personal injury, illness or death whilst overseas arising out of an activity which is not part of the arrangements made by Ski Chamois and which is the responsibility of a third party, we will provide advice, guidance, assistance and legal help in resolving your claim against that third party up to a maximum of £5,000 to cover your expenses. Should any payment be made to you or any member of your party by us in any circumstances referred to in this section we reserve the right to claim in your place against the person or organisation responsible for causing illness, injury or death, this means that you must agree to assign that part of your rights to us and we be subrogated to those rights.
All tickets for travel are subject to the conditions on the ticket issued by or on the behalf of the carrier concerned some of which may limit liability. This Website or brochure is the responsibility of Ski Chamois; it is not issued on behalf of, and does not commit the ferry companies mentioned therein in any way.


DELAYS

Ski Chamois shall not be liable for any delays or cost incurred in rail, road, sea or other services, as a result of weather, floods, war, strikes, quarantine, sickness, riots or other causes.


PRICES

Ski Chamois have only surcharged twice in 29 years of trading. We do reserve the right to surcharge on the following times: Government action or change in even in this case we will absorb the first 2% basic holiday cost and any surcharge will not exceed the limits set out in the government regulations on holidays. Brochure prices are based on a rate 1.4 Euros to the pound.


ARBITRATION

If you have a problem during your holiday, please inform the chalet manager or manageress immediately who will endeavour to put things right. If your complaint that cannot be resolved locally, you must write to our office within 28 days of your return home giving your booking reference and any local information. It is therefore a condition of this contract that you communicate any problem to the supplier of the service in question WHILST IN THE RESORT, and by fax to our office. If you fail to follow this simple procedure we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the problem.
It is unlikely that you will have a complaint that cannot be settled amicably between us. However, disputes out of, or in connection with this cannot be settled, May (if you wish) be referred to arbitration under a scheme administered by the Institute of Arbitrators.
If you should seek redress under this scheme then written notice requesting arbitration must be made no later than 9 months after return from holiday.


BROCHURE DESCRIPTIONS

All information published on our website or in our brochure has been complied from up-to-date details and Ski Chamois has taken utmost care to ensure accuracy, Nevertheless, there may be times when advertised features are modified or not available owing to circumstances beyond our control.

REFUNDS

No refunds on unused tickets, accommodation or transfers will be made unless a refund can be obtained from the carrier.


JURISDICTION

Your contract is made on the terms of these booking conditions, which are governed in all respects by English Law and both parties shall submit to the jurisdiction of English Courts at all times
